As part of our regulatory appeal process, anyone who requests an appeal must follow our regulatory timelines. Find out how our appeal process works.

Every decision we issue is governed by provincial legislation. Examples of decisions include approvals for licences, leases, authorizations, and certificates. The following table details

  • what type of decisions can be appealed (in accordance with legislation),
  • who can file a request for regulatory appeal, and
  • our request deadlines.

Enforcement order or environmental protection order issued under the Environmental Protection and Enhancement Act Any eligible person* Depending on the authority exercised, 7 or 30 calendar days from the date the enforcement order or the environmental protection order is issued

Gas Resources Preservation Act
Approval issued under the Gas Resources Preservation Act Any eligible person* 30 calendar days after the notice of decision is issued
Oil and Gas Conservation Act

Order issued under the Oil and Gas Conservation Act, including the following:
  • order to suspend or abandon a well or facility
  • order to pay suspension costs, abandonment costs, or reclamation costs
  • order to shut down or close a well or facility

Oil Sands Conservation Act
Approval issued under the Oil Sands Conservation Act Any eligible person* 30 calendar days after the notice of decision is issued
Order issued under the Oil Sands Conservation Act, including the following:
  • stop order

Pipeline Act

Order issued under the Pipeline Act, including the following:
  • order to discontinue or abandon a pipeline
  • order to pay discontinuation costs or abandonment costs
  • order to suspend construction or operation

Public Lands Act

Enforcement order for contraventions of provisions of Alberta Land Stewardship Act regional plan issued under the Public Lands Act Any eligible person* 7 calendar days from the date the enforcement order was issued

* An eligible person is

  • any person who is directly and adversely affected by a decision of the AER under an energy resource enactment,
  • any person who is permitted under the specified enactments to file a notice of appeal under those enactments, or
  • any other person described in the regulation
