Coal Valley Mine
The Alberta Energy Regulator (AER) has received Coal Conservation Act (CCA) application No.1949811, Environmental Protection and Enhancement Act (EPEA) application No. 040-11066, and Water Act (WA) application No. 003-00383119.
Description of the Application
Prairie Mines and Royalty ULC (PMRU) has applied for the Coal Valley Mine (CVM):
- To amend the EPEA approval No. 00011066-03-00 to approve the increased disturbance footprint and the modifications required to mine within the Pit 26 and Pit 26 Extension area;
- To amend WA approval No. 00383119-00-00 to approve upgrades to existing water management infrastructure and the replacement of existing Centre Creek Pond with a new settling pond, referred to as Centre Creek Pond 2; and
- To amend CCA mine license C 90-2 to approve the expansion of Pit 26, to continue to use of Dumps 1, 2 and 3, the removal of Center Creek Pond 1, and the construction of Centre Creek Pond 2.
Development and mining within Pit 26 have been ongoing since 2023. This application reflects the change in mine plan to extend Pit 26 as it has been determined that there is more recoverable resource than is currently contained within the existing licensed design. The approval of this application will see mining in this area continue until approximately 2030.
The Pit 26 expansion Project Area currently encompasses a portion of Township 047, Range 19, West of the 5th Meridian. The facility is located at NE and SE 24-047-20 W5M and Latitude: 53°04’13.9”N and Longitude: 116°47’21.7”W.

Contents of a Statement of Concern
For your submission to be considered a valid statement of concern, it must include
- why you believe you may be directly and adversely affected by a decision of the AER on the application;
- the nature of your objection to the application;
- the outcome of the application you advocate;
- the location of your land, residence, or activity in relation to the location of the energy resource that is the subject of the application; and
- your contact information, including your name, address in Alberta, telephone number, and email address or, if you do not have an email address, your fax number.
The AER also requests that you include the application number in your statement of concern.
Confidentiality
Section 49 of the Alberta Energy Regulator Rules of Practice (Rules of Practice) requires that all documents and information filed in a proceeding be placed on the public record. If you file a submission, you must not include any personal information that you do not want to appear on or are not authorized to put on the public record. Section 49(2) of the Rules of Practice states how to apply to the AER for an order to keep information confidential. The Rules of Practice is available on the AER website at www.aer.ca.
Jurisdiction
Submissions relating exclusively to compensation for land use are not dealt with by the AER and should be referred to the Land and Property Rights Tribunal (formerly the Surface Rights Board).
Under section 21 of the Responsible Energy Development Act, the AER does not have the jurisdiction to assess the adequacy of Crown consultation associated with the rights of aboriginal peoples as recognized and affirmed under the Constitution Act, 1982.
