The Alberta Energy Regulator (AER) has received Environmental Protection and Enhancement Act (EPEA) application 001-00496728, Water Act (WA) applications 001-00496729 and 001-00496730 and Coal Conservation Act (CCA) applications 1945552 and 1945553 from Summit Coal Inc. (Summit) for its proposed No. 14 Mine Project.
An application for a licence of occupation (LOC) for an access road from Highway 40 to the mine portal area and an application for a mineral surface lease (MSL) for the mine portal area, under the Public Lands Act (PLA) will be available through the AER’s OneStop system.
The AER is reviewing these applications together.
This notice also sets out the deadline for filing a statement of concern under the section How to File a Statement of Concern.
Description of the Applications
Summit has applied for a new EPEA approval under the EPEA, for a new WA approval and a new WA license under the WA, and to amend mine permit C 2009-6A and mine licence C 2011-9C under the CCA for the construction and operation of an underground mine which includes:
- Surface mine portals;
- Surface facilities including:
- Rotary breaker(s);
- Coal storage and loadout silo(s); and
- Mine Infrastructure;
- Multi-level underground mine (room and pillar method);
- Mine access / haul road;
- Water management and drainage control features;
- An increase to the Mine Permit project boundary of 130 ha to include the revised main access road; and
- An increase to the Mine Licence project boundary of 82 ha to cover the full extents of the projected underground mining area.
The coal produced is proposed to be primarily used as high-quality, low to mid volatile, bituminous metallurgical grade coal for export markets. The operational duration of the Project will be approximately nine years, including reclamation, at 1,300,000 tonnes of run-of-mine coal per year. Coal will be transported from the mine portal site to the previously approved Milner Coal Beneficiation Facility or rail loading facility via the proposed Access Road and Highway 40.
The proposed project is located in west-central Alberta approximately 3.2 km northeast of Grande Cache in portions of Township 057, Range 08, West of the 6th Meridian. The underground workings area and aboveground portal site are located in portions of Sections 14, 15, 16, 21, 22, 23 and 28 Township 057, Range 08, West of the 6th Meridian.

Requirement to File a Statement of Concern
If you have concerns with these applications, you must file a statement of concern as described below. If you do not file a statement of concern, the AER may approve the applications without further notification.
How to File a Statement of Concern
For your submission to be considered a valid statement of concern, it must be filed by 11:59 p.m. on the filing date below. Send one copy of your statement of concern to Summit Coal Inc. at the name and address above and one copy either online via the AER’s web-based form or by mail or email:

Contents of a Statement of Concern
For your submission to be considered a valid statement of concern, it must include
- why you believe you may be directly and adversely affected by a decision of the AER on the application;
- the nature of your objection to the application;
- the outcome of the application you advocate;
- the location of your land, residence, or activity in relation to the location of the energy resource that is the subject of the application; and
- your contact information, including your name, address in Alberta, telephone number, and email address or, if you do not have an email address, your fax number.
The AER also requests that you include the application number in your statement of concern.
Confidentiality
Section 49 of the Alberta Energy Regulator Rules of Practice (Rules of Practice) requires that all documents and information filed in a proceeding be placed on the public record. If you file a submission, you must not include any personal information that you do not want to appear on or are not authorized to put on the public record. Section 49(2) of the Rules of Practice states how to apply to the AER for an order to keep information confidential. The Rules of Practice is available on the AER website at www.aer.ca.
Jurisdiction
Submissions relating exclusively to compensation for land use are not dealt with by the AER and should be referred to the Land and Property Rights Tribunal (formerly the Surface Rights Board).
Under section 21 of the Responsible Energy Development Act, the AER does not have the jurisdiction to assess the adequacy of Crown consultation associated with the rights of aboriginal peoples as recognized and affirmed under the Constitution Act, 1982.
