Regulatory Appeal of a Reclamation Certificate
NOTE: The initial notice of scheduling of hearing was issued on January 14, 2022. This notice provides updated information about the recording of the hearing.
The Alberta Energy Regulator (AER) will hold a public hearing for regulatory appeal 1933054, which is an appeal of the AER’s decision to issue reclamation certificate 382273 to Whitecap Resources Inc. (Whitecap). A notice of hearing was issued on June 14, 2021. The hearing will be held online, using electronic means (Zoom) starting on March 8, 2022, at 9:00 a.m. The hearing will be audio webcast at www.meetview.com/aer.
The AER had scheduled a public hearing for regulatory appeal 1933054, starting on January 25, 2022. The AER received a request from one of the parties to reschedule the hearing. After receiving submissions from the other parties, the AER agreed to grant the request.
Participants are responsible for ensuring that they have access to all evidence filed on the record of the hearing, either through SharePoint or in their preferred format.
Description of the Proceeding
On July 17, 2020, the AER received a request for a regulatory appeal, under Part 2, Division 3 of the Responsible Energy Development Act and Part 3 of the Alberta Energy Regulator Rules of Practice, of the AER’s decision to issue reclamation certificate 382273 to Whitecap on July 18, 2019, regarding a wellsite, associate workspace, and access roads located at Didsbury, Alberta at Block 2, Lot 3, Plan 151 2407 or LSD 08, Section 18, Township 31, Range 1, West of the 5th Meridian.
The AER granted the request for the regulatory appeal in part on May 14, 2021. Specifically, the regulatory appeal was granted to consider the question of whether the reclamation certificate was properly issued.
The purpose of the hearing is to determine whether the AER should confirm, vary, suspend, or revoke its decision to issue reclamation certificate 382273.
