The Alberta Energy Regulator (AER) has received application 1881219.

Description of the Application

Suncor Energy Operating Inc. (Suncor) has applied on behalf of Fort Hills Energy Corporation under section 13 of the Oil Sands Conservation Act (OSCA) for approval of its fluid tailings management plan (TMP) for its Fort Hills mine.

The Fort Hills mine is located about 80 km north of Fort McMurray and about 25 km north of Fort McKay, within Townships 96, 97, and 98; Ranges 9, 10, and 11; West of the 4th Meridian, in the Regional Municipality of Wood Buffalo.

Enhanced Participation

The AER has a new process to enhance public involvement in the review of TMP applications. Under this new process, parties who may be directly and adversely affected by the AER’s decision and parties who could materially assist the AER in making this decision may be included in the initial review of the application.

Filing a Statement of Concern or a Request to Participate in the TMP Application Review

  • If you may be directly and adversely affected, you may file a statement of concern.
  • If you will not be directly and adversely affected but could materially assist the AER in its review of the TMP application, you may file a request to participate in the review.

If you do not file a statement of concern or request to participate, the AER may approve the application without notifying you.

How to File a Submission

Your submission (i.e., statement of concern or request to participate) must be filed before 4:00 p.m. on April 5, 2017.

Contents of a Statement of Concern

For your statement of concern to be valid, it must include

  • why you believe you may be directly and adversely affected by a decision of the AER on the application;
  • the nature of your objection to the application;
  • the outcome of the application you advocate;
  • the location of your land, residence, or activity in relation to the location of the energy resource that is the subject of the application; and
  • your contact information, including your name, address in Alberta, telephone number, and email address or, if you do not have an email address, your fax number.

The AER also requests that you include the application number in your statement of concern.

Contents of a Request to Participate in the TMP Application Review

For your request to participate to be valid, it must include a concise explanation of how

  • your participation will materially assist the AER in making a decision on the application (e.g., you can provide project-specific, detailed technical information);
  • you have a tangible interest in the subject matter of the review (e.g., you participate on committees or are involved in other activities related to oil sands tailings); and
  • your participation will not unnecessarily delay the review.

Your request must also include your contact information, including your name, address in Alberta, telephone number, and email address or, if you do not have an email address, your fax number.

The AER also requests that you include the application number.

Confidentiality

Section 49 of the Alberta Energy Regulator Rules of Practice (Rules of Practice) requires that all documents and information filed in a proceeding be placed on the public record. If you file a submission, you must not include any personal information that you do not want to appear on or are not authorized to put on the public record. Section 49(2) of the Rules of Practice states how to apply to the AER for an order to keep information confidential. The Rules of Practice is available on the AER website at www.aer.ca.

Jurisdiction

Submissions relating exclusively to compensation for land use are not dealt with by the AER and should be referred to the Alberta Surface Rights Board.

Under section 21 of the Responsible Energy Development Act, the AER does not have the jurisdiction to assess the adequacy of Crown consultation associated with the rights of aboriginal peoples as recognized and affirmed under the Constitution Act, 1982.
